Historic NASCAR Lawsuit Moment

This isn’t the first time NASCAR settled a civil lawsuit. Back in 2002, Francis Ferko, backed by SMI sued NASCAR, claiming that NASCAR had unfairly denied Texas Motor Speedway a second Cup Series date. The case put pressure on NASCAR’s scheduling practices and raised antitrust concerns. It ultimately ended in 2004 with a settlement. SMI received a second race at Texas Motor Speedway and Darlington lost one of its traditional dates. It is worth noting, the two parties never went to trial.
